Terms and Conditions
Overview
All tours booked through Moipo Adventure, a locally owned adventure travel agency located in Moshi, Tanzania, are subject to the following Terms & Conditions. The agreement between you and Moipo Adventures is governed by these terms. Please take the time to read them carefully before making any reservations.
By making a reservation with Moipo Adventures, you are indicating that you have read, understood, and agree to be bound by these Terms and Conditions. This acceptance applies not only to you but also to any clients listed in your confirmed reservations, including minors and individuals with disabilities. Therefore, each client in your group agrees to these Terms and Conditions.
The customer who confirms the reservation will be considered the primary contact for all additional clients included in the booking.
Deposit and final payment
To reserve a tour with Moipo Adventures, a 25% down payment is required to initiate the booking process. Upon making the down payment, the client will receive an invoice with payment instructions.
The remaining balance must be paid in full at least 15 days before the tour begins. If a reservation is made less than 15 days before the tour's start date, the entire payment must be made at that time.
Please note that bank fees and credit card transaction fees do not apply to payments made to Moipo Adventures. Any fees incurred from third-party financial institutions due to the use of a credit card or other payment methods are the customer's responsibility. Moipo Adventures will not reimburse or return any money paid in connection with tour bookings.
Booking agreement
In relation to payments made by customers to Moipo Adventures through third parties, the following terms apply: When Moipo Adventures receives the necessary deposit from the client, and the client receives written confirmation of the booking, the reservation is confirmed, and these Terms and Conditions will apply. To confirm the reservation, the client must be at least 18 years old and must provide Moipo Adventures with all the necessary information. Any customer who confirms a reservation for tours that include more than one person listed on the reservation agrees to the following representations and warranties:
They have secured all necessary authorizations and consents to make the booking on behalf of all the other clients listed in the reservation. Additionally, they have provided those clients with all the information required for them to give their free and informed consent.
They have provided accurate information about each client and secured all necessary authorizations and consents to share this information with Moipo Adventures, which is required to complete the booking.
Cancellation Policy
Cancellations must be communicated directly to Moipo Adventures. The cancellation fees are outlined below as a percentage of the total price paid for the trip being cancelled. These fees are based on the date when Moipo Adventures receives the cancellation request.
Cancellations made 35 days or more before the tour start incur no fees.
Cancellations made between 11 and 34 days before the tour start will incur a 30% cancellation fee.
Cancellations made between three to ten days before the tour begins will incur a 50% cancellation fee.
Cancellations made less than 48 hours before the tour will incur a 100% cancellation fee.
Customized tours may have different cancellation policies, which we'll share with qualified clients at booking.
Travel Insurance
Clients must obtain travel insurance from their home country, which should include minimum coverage for medical expenses, evacuation, and baggage. Moipo Adventures does not provide travel insurance for repatriation for any travel dates involving their services. Emergency medical costs and personal injury must be covered by this insurance.
We strongly advise customers to expand their insurance to include coverage for cancellation and any other potential expenses arising from loss, damage, injury, delay, or inconvenience. The price of the trip does not include any insurance coverage, and customers are responsible for securing additional insurance for a fee beyond the tour price.
When purchasing travel insurance, customers should ensure that the insurer is informed about the type of travel they will be doing so that the policy accurately reflects the coverage required for the specific tour.
Medical Conditions
All clients are required to truthfully provide relevant medical information to Moipo Adventures when booking their tour. Clients are responsible for evaluating their own suitability and capability to participate in the tour. We recommend that all clients consult with their physician regarding their fitness for the booked tour. Additionally, Moipo Adventures advises clients to seek their physician’s guidance on necessary or recommended vaccinations, medical precautions, or any other health-related concerns for their entire trip with us.
Please note that Moipo Adventures does not provide medical advice. Our adventure tours take place in remote or less developed regions of Tanzania, where medical facilities may not meet the standards of those in the client’s home country. The quality of medical facilities in these areas can vary significantly, and Moipo Adventures makes no representations or guarantees regarding the standard of these facilities or the medical treatment available in those regions.
Special Requirements
Moipo Adventures will make every effort to accommodate clients' special requests, including dietary and accommodation needs. However, please note that these requests do not constitute part of the Terms and Conditions or the contract between the client and Moipo Adventures. As such, Moipo Adventures is not liable for any failure to meet or fulfill these requests.
Prices, Surcharges and Taxes
Due to the nature of the tourism industry in Tanzania and the associated costs, the published price of any tour product is subject to change at any time, including after booking confirmation, up to 30 days before the tour's departure. Moipo Adventures reserves the right to impose surcharges on any tour products. These surcharges may be necessary due to increases in accommodation costs, transportation fees, fuel prices, taxes, third-party supplier fees, currency fluctuations, park fees, or any governmental actions that impact tour prices. Surcharges will only be applied if the increase is significant enough to warrant it.
Moipo Adventures will notify affected clients as soon as possible upon learning of the need for a surcharge. Upon receiving this notification, clients may choose to cancel their tour booking without incurring any penalty, or they may accept the new price. Clients must notify Moipo Adventures of their decision within 14 days of receiving notice of the increase. If they do not respond within this timeframe, they will be deemed to have accepted the price change and will be responsible for the increased payment.
Occasionally, Moipo Adventures may offer reduced pricing on selected tours. However, this reduced pricing applies strictly to new bookings. Bookings that have already been confirmed—defined as those for which a deposit has been received—are not eligible for the reduced pricing.
Guaranteed Departures and Cancellation of a Tour by Moipo Adventures
Moipo Adventures guarantees that all scheduled group tour departures booked by a client will proceed as planned, although reasonable changes to the itinerary may occur. Brochures and other printed materials containing tour information and departure dates are subject to change, and these dates are excluded from this guarantee. A departure becomes guaranteed once at least one client has a confirmed booking. This guarantee does not apply in cases of Force Majeure.
If Moipo Adventures cancels a tour before the scheduled departure date for reasons not related to Force Majeure or the client's fault or negligence, the client has the following options:
Accept a substitute tour product of equivalent or superior value from Moipo Adventures, if such a substitute is reasonably available.
Accept a substitute tour of lower value if no equivalent or superior tour is available and receive a refund for the price difference between the originally purchased tour and the substitute.
Request a full refund of all payments made for the canceled tour.
Moipo Adventures is not responsible for any incidental expenses or consequential losses incurred by the client due to the canceled booking, such as visas, vaccinations, non-refundable flights or rail tickets, non-refundable parking or other fees, loss of income, or loss of enjoyment.
Moipo Adventures reserves the right to issue a full refund instead of the previously mentioned options at its sole discretion. If a significant element of the tour cannot be provided after departure, Moipo Adventures will make suitable alternative arrangements to continue the tour. If suitable alternatives are not possible or the client reasonably rejects them, Moipo Adventures will provide a refund for any unused tour products or portions of the tour.
Cancellation of a Tour by the Client
If a client is unable to proceed with a booked tour due to reasons beyond their control, they may transfer their tour booking to another person who meets all the relevant conditions for the tour. This transfer must be communicated to Moipo Adventures at least 14 days before the scheduled departure date.
In the case of such a transfer, both the original client and the new client will be jointly responsible for paying the tour price (or any outstanding balance if part of the price has already been paid) along with any additional costs resulting from the transfer.
For private tours, Moipo Adventures can hold a reservation if a client decides to postpone their tour to a later date. However, the client will still be liable for any cancellation fees as outlined in the cancellation policy and for any unforeseen additional costs incurred until the tour takes place later (such as accommodation costs, transportation costs, fuel costs, dues, taxes, or fees from third-party suppliers, as well as currency fluctuations, park fees, tax increases, or any government actions that affect tour pricing).
Cancellations and Changes
By signing up for a tour with Moipo Adventures, the client agrees that reasonable changes to the tour and/or schedule may be made by Moipo Adventures due to the nature of adventurous travel, particularly in Africa. The client understands that the route, schedule, accommodations, itineraries, amenities, and modes of transport may change without prior notice due to circumstances beyond Moipo Adventures' control. These circumstances may include illness, mechanical breakdowns, incidents in the tour location, flight cancellations, strikes, political disputes, entry or border difficulties, extreme weather, and other unpredictable or unforeseeable events.
Moipo Adventures is not liable to any client for such changes or amendments. Additionally, Moipo Adventures will not provide discounts or refunds for missed or unused services resulting from changes that are not the fault of Moipo Adventures, its suppliers, or representatives. This includes instances where a client's participation in the tour is terminated due to their own actions, negligence, or breach of these Terms and Conditions.
While Moipo Adventures will strive to ensure that the tour you have booked goes as planned, we do not guarantee adherence to the agreed tour itinerary. We reserve the right to amend the tour itinerary if necessary or advantageous. We will make every effort to notify you of any changes before the tour departure; however, we are not obligated to do so and are not liable for any refunds claimed as a result of such changes.
Moipo Adventures does not manage the accommodations we use on our tours. Therefore, there may be occasions when our accommodation providers inform us that reserved accommodations are no longer available due to reasons outside our control. In such cases, we will provide alternative accommodations of at least the same standard or a higher standard.
If it becomes necessary to amend the tour itinerary during the tour, the tour guide will arrange the best available alternative. The decision to make such changes will rest with the tour guide, and their decision is final. This is particularly applicable, but not limited to, mountain climbing products, where the guide may determine that a client is unable to continue the climb due to illness, injury, extreme weather, or other factors beyond the guide’s control.
Risk
The customer understands that our trip products are adventurous in nature and may pose a high risk to their health and safety. Adventure travel inherently carries risks, and by confirming their booking, the client acknowledges having considered these risks and is willing to accept them to the fullest extent permitted by law. The client assumes all such risks and releases Moipo Adventures from any claims or actions resulting from losses, damages, injuries, or death arising from the inherent risks of travel, particularly in relation to adventure travel, which may include visiting wild and remote areas and participating in various adventurous activities outlined in the tour itineraries.
The standards of hygiene, accommodation, and transport in some areas where the tours operate may be lower than what the client might reasonably expect in their home country or region. The client acknowledges that the level and nature of risk involved depend on the specific tour booked or the locations visited, with significant personal risks associated, especially if the tour includes physical activities, travel to remote locations, high-altitude activities, or other high-risk endeavors, particularly in areas of Tanzania with underdeveloped infrastructure.
The client confirms that they have evaluated the potential risks, dangers, and challenges based on their personal capabilities and needs, and they expressly assume the risks associated with travel under such conditions. Moipo Adventures will provide information or guidance regarding local customs, weather conditions, safety concerns, physical challenges, or applicable laws in the tour locations to the best of its ability. However, Moipo Adventures will not be liable if the client does not act according to the information provided.
The client must adhere to all relevant laws and regulations of Tanzania and the regions visited during the tour. If the client fails to comply with these requirements or engages in any illegal activity, or if Moipo Adventures reasonably deems the client’s behavior to be causing or likely to cause danger, distress, or material annoyance to others, Moipo Adventures has the right to terminate the client’s travel arrangements immediately. In such a case, Moipo Adventures will not be liable for any refunds for unused or missed services or costs incurred due to the termination, including return travel, accommodations, meals, and incidentals.
Clients are responsible for any costs incurred by Moipo Adventures due to damage, destruction, theft, or excess cleaning fees caused by the client while on tour. Clients must report any pre-existing damage to the accommodation, transportation service, or facility staff and/or a Moipo Adventures representative as soon as they discover it.
While on any Moipo Adventures tour, clients agree to take all reasonable precautions for their safety. This includes, but is not limited to, wearing safety equipment such as seatbelts, harnesses, and helmets as instructed and adhering to posted signs and warnings regarding health and safety. The client's failure to follow safety instructions or suggestions from Moipo Adventures or its third-party suppliers is not the responsibility of Moipo Adventures or its suppliers.
Complaints
The client agrees to inform Moipo Adventures of any complaints regarding a tour as soon as possible, allowing Moipo Adventures the opportunity to address the issue appropriately. The client also agrees to immediately notify the head guide or any authorized representative of Moipo Adventures of any changes. Moipo Adventures is not liable for complaints that are not communicated to them promptly, which would allow them to resolve or attempt to resolve the issues. Any complaints made after the conclusion of a tour must be submitted in writing to Moipo Adventures within 30 days of the tour's end.
Third Party Suppliers
To provide you with the travel and other services you purchase, which make up your tour product, Moipo Adventures enters into agreements with various third-party suppliers. These include accommodation providers, activity providers, airlines, coach companies, transfer operators, shore excursion operators, tour guides, and other independent parties.
While Moipo Adventures takes reasonable care in selecting these third-party suppliers, it is important to note that Moipo Adventures cannot control or supervise them. Consequently, Moipo Adventures cannot be held responsible for their actions or omissions. The terms and conditions established by these suppliers, including their tariffs, conditions of carriage, ticket and voucher terms, as well as relevant international treaties, may limit their liability concerning the services provided. This means that their liability might be restricted or excluded.
Clients acknowledge that these third-party suppliers operate in compliance with the applicable laws of Tanzania, and Moipo Adventures does not guarantee that any third-party supplier complies with the laws of the client’s country of residence or any other jurisdiction.
To the fullest extent permitted by law, Moipo Adventures is not liable and will not assume responsibility for any claims, losses, damages, costs, or expenses that arise from inconvenience, loss of enjoyment, disappointment, distress, or frustration—whether physical or emotional—that may result from the actions or omissions of parties other than Moipo Adventures and its employees. For clarity, neither Moipo Adventures nor any carrier is liable for the actions or omissions, whether negligent or otherwise, of third-party suppliers or independent contractors.
Liability
When a client's actions are at fault, or when an unforeseen or unavoidable act or omission occurs due to a third party unrelated to the services provided in our tours, or in the case of a force majeure event, Moipo Adventures is not liable for any damages, expenses, losses, or claims.
While clients are on a trip, Moipo Adventures cannot be held responsible for any loss, theft, or damage to their luggage or personal belongings. Clients should ensure that they do not leave their personal items unattended in public areas, on modes of transportation, or anywhere else. Clients are responsible for their own belongings at all times.
Moipo Adventures also cannot accept responsibility for, and will not be liable for, any loss or damage to valuables or other items left in or on facilities used by Moipo Adventures, such as hotels, homestays, vessels, expedition vehicles, or any other mode of transportation.
If Moipo Adventures or any third-party suppliers involved in the services provided as part of the contract are found to be negligent and cause damage, death, injury, or disease, Moipo Adventures limits its liability as permitted by applicable international conventions.
Force Majeure
Moipo Adventures shall not be held liable to the client for any death, bodily injury, illness, damage, delay, or any other loss or detriment to persons or property. This includes financial costs, both direct and indirect, incurred by the client. Furthermore, Moipo Adventures will not be responsible for its failure to commence, perform, or complete any duty owed to the client if such issues arise from events beyond its reasonable control. These events include, but are not limited to, acts of God, warfare or war-like operations, pandemics, mechanical breakdowns, terrorist activities or threats, civil disturbances, labor disputes, interference by authorities, political unrest, riots, insurrections, government restrictions, fires, extreme weather, or any other unforeseen occurrence.
Images and Marketing
The client acknowledges that while participating in any Moipo Adventures, other clients, Moipo Adventures representatives, or guides may take photographs or videos that may include the client, either in part or in full. The client gives their consent for such images, photos, and videos to be taken and grants Moipo Adventures, its affiliates, and assigns a perpetual, royalty-free, worldwide, irrevocable license to use these materials for any purpose, including marketing and promotional activities. This license covers any format, whether currently known or developed in the future, without any further obligation or compensation to the client.
Amendments
These terms and conditions may change at any time, with updates posted on the Moipo Adventures website. Any modifications will take effect 10 days after being published on the website. The most recent version of these terms, including any amendments, is always available on the Moipo Adventures website. Clients can also request a written copy from Moipo Adventures. Changes to these terms and conditions will be considered acknowledged by clients 10 days after their posting on the website. To stay informed about the latest version, Moipo Adventures recommends that all clients review the terms before their departure.
